  Employment, Assignment, Re-Employment, Termination of Employees Policy 217
 

The employment, re-employment, and termination or discharge of employees is the responsibility of the superintendent as provided by law. The assignment of employees is delegated to the superintendent with specific policy guidance in the matter of transfers of employees from one location to another as set out in policy 218.

A. The following schedule shall apply for re-employment of licensed and supervisory employees:

B. Employees’ Contracts:

  1. Notice of Re-employment; Termination: State law (Section 22-10A-22, NMSA 1978) requires the superintendent to serve written notice of re-employment or termination on each certified school instructor employed by the district. A notice of re-employment shall be an offer of employment for the ensuing school year. The employee must return the signed letter of intent within fifteen (15) calendar days of receipt of the notice of re-employment. This written acceptance of re-employment by a certified school instructor creates a binding employment contract between the certified school instructor and the school board until the parties enter into a formal written employment contract. A notice of termination shall be a notice of intention not to re-employ for the ensuing school year. The notice of intention not to re-employ a certified school instructor shall be served on or before fourteen (14) calendar days prior to the last day of the existing school year. (See 6.67.2 NMAC.)
  2. Licensed Administrative and Supervisory Staff Contracts: School employees who are licensed administrators or supervisory employees shall have their status reviewed annually by the superintendent with action taken no later than the last day of April of each school year.
  3. Non-Licensed Employee Contracts: Non-licensed employees shall be considered for re-employment before June 30th of each year for a term not to exceed one (1) year.
  4. Non-tenured licensed school employees shall be given written notice of re-employment or termination or on before the last day of the school year of the existing employment contract.
